CUSTOMS GENERAL ADMINISTRATION
 RULES  OF  THE  CUSTOMS  OF  THE PEOPLE'S REPUBLIC OF CHINA ON
CONTROL OF INCOMING AND OUTGOING PRINTED MATTER AND AUDIO AND VIDEO
PRODUCTS CARRIED OR POSTED BY INDIVIDUALS
 (Promulgated  by  the  General Administration of Customs of the
People's Republic of china on July 10, 1991)
 @@  Article  1. These Rules are formulated in accordance with the
Customs Law  of the People's Republic of China and other laws and
regulations of the state with a view to implementing the state
policy of opening to the outside world and facilitating the exchange
with foreign countries in the fields of science and technology and
culture.
 @@ Article 2. The incoming and outgoing printed matter mentioned in
these Rules  refers to the reproductions of the same content printed
on paper or other conventional materials by mechanical or photographic
means using zinc, mold  or  photographic  plates  as  well as to
photographic negatives, paper molds, paintings, clippings, manuscripts,
handwritten copies and duplicates.
 The  audio  and  video products mentioned in these Rules refer to
gramophone records,  audio  and  video tapes, laser video discs,
laser audio discs, cinefilms, lantern slides and various media of
stored information.
 @@  Article  3.  Individuals  carrying or sending by post printed
matter and audio  and video products into or out of the country shall
make  declarations  at  the  Customs  office  and accept Customs
supervision  and  control. If the articles  contain  no contents
forbidden to enter or leave the country, they shall be let pass at a
reasonable amount for personal use, while that part of the articles
exceeding the reasonable amount for personal use shall be sent back.
 @@  Article  4.  Printed  matter and audio and video products
containing any of the following contents are prohibited from entering
the country:
 1.  Attacks  on stipulations of the Constitution of the People's
Republic of China;  calumniation  of the current state policies;
libel  against the Chinese  leaders of the Communist Party and the
state; inciting subversion and  sabotage of the People's Republic of
China and sowing discord among the Chinese  nationalities;  and
advocacy  of  "two  chinas" or "Taiwan independence".
2. Detailed descriptions of sexual behavior, or pornography.
3. Propagation of superstitions or homicide and violence.
 4.  Other contents harmful to the politics, economy, culture and
morality in the country.
 @@ Article 5. Travellers carrying printed matter and audio and
video products  of  religious  nature are allowed to bring into
the country a reasonable  amount of such articles for their own
personal use and that part of the articles exceeding the reasonable
amount for personal use shall be refused entry.
 The  sending  by  post  of  printed  matter and audio and video
products of religious nature into the country for distribution is
prohibited.
 @@  Article  6.  Printed  matter and audio and video products
containing any of the following contents are prohibited from leaving
the country.
1. Contents specified in Article 4 of these Rules.
2. Contents involving state secrets.
 3.  Printed  matter with markings of "For Internal Circulation"
or "For Circulation Inside the Country".
 4.  Ancient  and  antiquated  books  and other cultural relics of
historical value  prohibited from leaving the country according to
the "Referential Standards  for  Appraisal of Cultural Relics for
Export," promulgated by the State.
  5.  Other  printed  matter  and  audio  and  video  products
prohibited from leaving  the country by official orders of relevant
government departments in charge.
 @@  Article  7.  The embargoed printed matter and audio and video
products carried or posted by individuals shall be confiscated by the
Customs.
 The  Customs  office  shall  deal with the cases false Customs
declarations, refusal  of Customs inspection or evasion of Customs
supervision and control in accordance with the Customs Law of the
People's Republic of China and the Detailed Rules and Regulations for
meting Out Administrative penalties in Implementing the customs Law
of  the  people's Republic of China, as well as other relevant
regulations.
 @@  Article 8. The carrying or posting by individuals of the printed
matter and  audio  and  video  products  specified  in Item 2 of
Article 4 of these Rules  shall  be dealt with by the Customs
office,  apart  from  their confiscation, according to the following
stipulations with reference to the circumstances involved.
 1. No fines shall be imposed on those who have made customs
declarations.
