CHAPTER I GENERAL PROVISIONS
@@ Article 1. In accordance with the Regulations on the
Inspection of Import and Export Commodities of the People's
Republic of China and the requirements of the Detailed Rules
for the Implementation of the Regulations on the Inspection of
of Import and Export Commodities of the People's Republic of China,
these Administrative Regulations are formulated to strengthen the
administration of laboratories undertaking inspection of import and
export commodities, to ensure the orderly implementation of
inspection and test activities, to provide accurate and reliable
inspection and test data required in the unified supervision and
administration of the inspection of import and export commodities and
create necessary conditions for international accreditation of test
laboratories in the field of foreign trade.
@@ Article 2. All laboratories and inspection and test bodies
(hereinafter referred to as the commodity inspection laboratories)
designated by the State Administration of Commodity Inspection and
the commodity inspection bureaux of provinces, autonomous regions and
municipalities directly under the Central Government (hereinafter
referred to as the commodity inspection authorities) to undertake
inspection, test, analysis, surveying of import and export
commodities and to participate in activities of export product
accreditation, quality licencing, quality supervision and random
inspection and quality appraisal shall be under the control of
these Administrative Regulations.
@@ Article 3. Commodity inspection laboratories meeting the
requirements of accreditation standards shall be accredited
and granted the Accreditation Qualified Certificate.
CHAPTER II ACCREDITATION AUTHORITIES
@@ Article 4. The State Administration of Import and Export
Commodity Inspection centralizes the administration of
accreditation of commodity inspection laboratories. The
accreditation of commodity inspection laboratories is dealt with
at the national and regional levels, organized and implemented
respectively by the State Administration of Commodity Inspection
and local commodity inspection bureaux. Commodity inspection
laboratories at the national level shall be geared to the needs
of the whole country, whereas local commodity inspection
laboratories shall chiefly deal with the inspection and testing of
commodities in the local area.
@@ Article 5. The commodity inspection authorities hall organize
experts and technicians concerned to form an accreditation
examination team to carry out the examination of the commodity
inspection laboratories seeking accreditation.
CHAPTER III FUNDAMENTAL REQUIREMENTS FOR ACCREDITATION
@@ Article 6. Any organization seeking accreditation of a
commodity inspection laboratory shall, in terms of organizational
structure, staff, rules and regulations, test and measurements,
equipment and instruments, environment and safety, meet the
requirements of inspection. The fundamental requirements are the
following:
1. A commodity inspection laboratory at the national level
shall be independent of the manufacturer, distributor and user of
commodities in terms of finance, technology and administration.
Commodity inspection laboratories at all levels shall be able
to perform independently the inspection, test and examination of
commodities, without being influenced in any way by the manufacturer,
distributor and user.
2. The allocation of various kinds of personnel in a commodity
inspection laboratory shall be well proportioned, with adequate
background in education, knowledge, capability and experience
corresponding to their duties.
3. A commodity inspection laboratory shall establish and put into
proper execution a system of technical and administrative
